Welcome to Eventprem Limited (“us”, “we”, or “our”). We operate an online marketplace based in the United Kingdom that facilitates the listing and booking of Experiences offered by independent sellers to buyers worldwide.
Please read these Terms and Conditions (“Terms”) carefully before using our website or services. By accessing or using our website, creating an account, or making a booking, you agree to be bound by these Terms.
If you do not agree with any part of these Terms, you must not use our website or services.
1. Definitions
In these Terms, unless the context otherwise requires:
• “Platform”, “we”, “us”, or “our” means the website and services operated by us as an intermediary marketplace.
• “Website” means our website, mobile applications, and related digital services.
• “User” means any person who accesses or uses the Platform, including Buyers and Sellers.
• “Buyer” means a User who books or purchases an Experience through the Platform.
• “Seller” means a User who lists, offers, or delivers an Experience through the Platform.
• “Experience” means any activity, service, event, or experience listed by a Seller and made available for booking through the Platform.
• “Booking” means a reservation made by a Buyer for an Experience through the Platform.
• “Fees” means any platform, service, or processing fees charged by us and disclosed before checkout.
• “Payment Processor” means a third-party payment service provider, including Stripe, card networks, and acquiring banks.
• “Chargeback” means a payment reversal initiated by a Buyer through their card issuer or payment provider.
• “Consumer Laws” means mandatory consumer protection laws applicable in the Buyer’s or Seller’s jurisdiction.
• “Content” means all text, images, listings, reviews, and other materials displayed on or submitted to the Platform.
2. Acceptance of Terms
By accessing and using the Platform, you confirm that you have read, understood, and agree to be bound by these Terms, together with our Privacy Policy and any additional policies referenced herein.
3. Use of the Platform
You agree to use the Platform only for lawful purposes and in a manner that does not infringe the rights of others or restrict their use of the Platform.
You must not:
• Use the Platform for unlawful, fraudulent, or misleading purposes
• Post or transmit offensive, defamatory, obscene, or harmful content
• Attempt to gain unauthorised access to systems or accounts
• Interfere with the security or operation of the Platform
4. Intellectual Property Rights
All Content on the Platform is owned by or licensed to us and is protected by applicable intellectual property laws.
You may not reproduce, distribute, modify, or exploit any Content without our prior written consent.
5. User Accounts
You may be required to create an account to access certain features.
You are responsible for:
• Keeping your login credentials secure
• All activity carried out under your account
We may suspend or terminate accounts at our discretion where there is a breach of these Terms or misuse of the Platform.
6. Marketplace Role and Merchant of Record
The Platform operates solely as an intermediary marketplace.
• Sellers act as the merchant of record for their Experiences unless explicitly stated otherwise
• We do not own, create, host, manage, or deliver Experiences
• Contracts for Experiences are formed directly between Buyers and Sellers
• Sellers are solely responsible for the fulfilment, quality, safety, legality, and delivery of their Experiences
7. Eligibility
• You must be at least 18 years old to use the Platform
• You must have legal capacity to enter into binding contracts
8. Bookings and Payments
Bookings
Bookings are made through the Platform in accordance with the instructions provided.
Payment
Payment is required at the time of booking. Accepted payment methods will be displayed at checkout.
Payment Processing
Payments are processed by third-party Payment Processors, including Stripe. We do not store or control payment card details.
Settlement, Payouts, and Processor Authority
Payouts to Sellers may be delayed, withheld, reversed, or recovered in accordance with Payment Processor requirements, dispute investigations, fraud prevention measures, risk controls, or applicable laws.
We may determine the format, timing, and submission of payment, refund, or dispute-related information where required by Payment Processors or card-network rules.
Confirmation
Once payment is successful, Buyers will receive a booking confirmation email and are responsible for reviewing details and reporting any errors promptly.
9. Pricing and Fees
• Prices are shown at the time of booking
• Platform or service Fees may apply and will be disclosed before checkout
• Prices may be shown in multiple currencies
10. Delivery of Experiences
• Sellers are responsible for delivering Experiences as described
• Dates, locations, inclusions, and requirements are set by Sellers
• We are not responsible for delays, changes, or failures caused by Sellers or third parties
11. Cancellations, Refunds, and Disputes (General)
• Cancellation and refund terms are set by Sellers and displayed in listings
• Seller policies must comply with applicable Consumer Laws
• We may assist with dispute resolution but are not obliged to issue refunds unless required by law
12. No-Show and Missed Experiences
If a Buyer fails to attend an Experience or meet participation requirements, refunds may not be issued unless required by law or the Seller’s stated policy.
13. Buyer-Specific Global Terms
13.1 Global Buyers
Buyers may be located anywhere in the world and acknowledge that Experiences may be governed by local laws where they take place and that Sellers may be based in different countries.
13.2 Buyer Responsibilities
Buyers are responsible for reading listings, meeting participation requirements, arriving on time, and following Seller instructions.
13.3 Consumer Rights
Nothing in these Terms limits mandatory consumer rights under applicable law.
14. Seller-Specific Terms
14.1 Seller Eligibility
Sellers must be at least 18 years old, have authority to offer Experiences, and comply with all applicable laws.
14.2 Listings
Sellers are responsible for accurate listings. We may remove or suspend listings at our discretion.
14.3 Licences, Safety, and Insurance
Sellers must hold required licences, maintain appropriate public liability insurance, and comply with health and safety regulations. Proof may be requested.
14.4 Seller Liability, Indemnity, and Chargebacks
Sellers acknowledge that they are the merchant of record and solely responsible for their Experiences.
Sellers agree to indemnify and hold us harmless, to the extent permitted by law, from claims arising from their Experiences.
Sellers must cooperate fully in Chargeback investigations and provide evidence promptly.
14.5 Seller Cancellations and Refunds
Sellers must clearly state refund policies and issue refunds where legally required or where their policy applies.
14.6 Seller Conduct
Sellers must act professionally and in good faith. Unsafe, abusive, discriminatory, or misleading behaviour may result in immediate action.
14.7 Suspension and Termination
Seller accounts may be suspended or terminated for breaches, failure to deliver Experiences, repeated complaints, or legal or safety violations.
14.8 Prohibited and Restricted Activities
Sellers must not offer Experiences that violate applicable laws or Payment Processor or card-network prohibited or restricted activity rules.
15. Risk and Assumption of Risk
Buyers acknowledge that Experiences may involve inherent risks and participation is voluntary.
Nothing in these Terms excludes liability for death or personal injury caused by negligence where such exclusion is prohibited by law.
16. Insurance
We do not provide insurance.
• Buyers are responsible for obtaining appropriate personal insurance
• Sellers are responsible for maintaining appropriate business and liability insurance
17. Cross-Border Taxes and Duties
Transactions may be cross-border. Each party is solely responsible for determining, reporting, and paying applicable taxes, VAT, or duties. We do not provide tax advice.
18. Force Majeure
We are not liable for delays or failures caused by events beyond our reasonable control.
19. Limitation of Liability
To the fullest extent permitted by law:
• We are not liable for losses arising from Buyer-Seller transactions
• We are not responsible for the quality, safety, or legality of Experiences
We may reverse, withhold, suspend, or recover funds where required by Payment Processors, card-network rules, fraud prevention measures, or legal obligations.
Our total liability shall not exceed the Fees paid to us for the relevant transaction.
20. Third-Party Links
The Platform may contain links to third-party websites. We are not responsible for their content or practices.
21. User Conduct
Users must act lawfully, respectfully, and in good faith. We may remove content, listings, or accounts that violate these Terms.
22. Dispute Resolution
Buyers and Sellers must first attempt to resolve disputes directly and in good faith.
If unresolved, either party may request Platform assistance. We may facilitate communication but do not determine legal liability or guarantee outcomes.
Chargeback outcomes are determined by Payment Processors or card issuers.
Users may pursue external legal remedies subject to governing law and jurisdiction.
23. Changes to Terms
We may update these Terms at any time. Continued use of the Platform constitutes acceptance of the updated Terms.
24. Severability
If any provision of these Terms is found to be unlawful, invalid, or unenforceable, that provision shall be deemed severed, and the remaining provisions shall continue in full force and effect.
25. No Waiver
Our failure or delay to enforce any provision of these Terms shall not constitute a waiver of our right to enforce that provision or any other provision at a later time.
26. Privacy Policy
Personal data is processed in accordance with our Privacy Policy.
27. Governing Law and Jurisdiction
These Terms are governed by and construed in accordance with the laws of England and Wales.
If you are a consumer, nothing in this clause shall limit your right to bring proceedings in your country of residence where such rights are granted by mandatory consumer protection laws.
For business users and Sellers, the courts of England and Wales shall have exclusive jurisdiction.
